The bylaws, which also increase the number of rooms in the Hyatt Hotel proposed adjacent to the Whistler Racquet and Golf Resort, were approved with no comments from councillors. At an Aug. 4 public hearing some owners of townhouses in the first phase of the Montebello complex, part of Park Georgia’s development, objected to a section of the bylaws which will allow future townhomes in phase II of Montebello to be rented nightly. Last week Todd Kerr, an owner in phase I of Montebello, told Pique Newsmagazine a group of Montebello owners are considering legal action against Park Georgia because of the change which will allow nightly rentals in phase II. "I bought this lot two years ago... and I was told it was going to be all residential, with no rentals," Kerr said. "Most of us bought on the representation that it was going to be residential only." Under the terms of the deal the municipality reached with Park Georgia the developer agrees not to clearcut a stand of alluvial spruce forest kitty-corner from the Whistler Health Care Centre if the company is able, over the next 18 months, to find a new location for a golf driving range near the Chateau Whistler golf course at Lost Lake. The spruce forest area, which was approved in 1990 as a site for a driving range and practice facility to be associated with the racquet and golf resort, has attracted interest in recent years for its environmental values. In return, Park Georgia has changed the layout of its hotel project and will be allowed to construct a nine storey high hotel, although the bottom storey will be at grade and will give the building the look of an eight-storey structure. Work on the Hyatt Hotel is expected to start next spring.
