Whistler resident convicted of dangerous driving

A 21-year-old Whistler man has been found guilty of dangerous driving causing bodily harm in relation to an Apr. 2004 incident.

On Feb. 9, Tyler Keenan Duncan, of Whistler, received a nine-month conditional sentence to be served in the community instead of incarceration.

Duncan, who was 19 year old at the time of the incident, struck a motorcyclist while traveling approximately 13 km south of Pemberton near Shadow Lake. The youth was driving his father’s BMW. Upon arrival on the scene, police discovered the car wrapped around a telephone pole.

The motorcyclist, who endured severe injuries to one of his legs, was air-lifted to Vancouver. He has since recovered.

The Whistler-Pemberton RCMP investigation into the cause of the accident revealed evidence that proved to be beyond a reasonable doubt that the driver of the BMW was driving in a dangerous manner before losing control of the vehicle.

Witnesses confirmed that the driver of the BMW was driving in an erratic manner starting from Whistler.

In the judgment handed down in Pemberton Provincial Court, Judge Moss cited both "excessive speed" and "driver inexperience" as two of the factors in the accident.

The terms of Duncan’s sentence include a curfew and a two-year prohibition on driving.
